Because IGS-Web LLC is established outside the European Union but offers services to, and monitors the behavior of, individuals located in the European Union and the United Kingdom, it processes personal data in accordance with:

  • Billing data: up to 10 years, in line with applicable accounting and tax retention obligations (previously governed by French accounting law under the prior French operator; retention periods for records already created under that entity continue to be honored)
  • Comments: retained indefinitely unless deletion is requested
  • User accounts: until a deletion request is made

12. Where Your Data Is Processed

Hosting location of client websites and infrastructure. For client websites and applications hosted or managed by IGS-Web LLC, the underlying server infrastructure, databases, and backups are located in France or elsewhere in the European Union, except where a client is based in the United States or otherwise expressly requests or requires hosting outside the EU, in which case infrastructure may be located in the United States or another jurisdiction appropriate to that client's needs. Data collected and stored through a client's hosted website therefore generally remains within the EU/EEA at rest, unless the applicable written agreement with that specific client states otherwise.

Administrative and controller-level processing. Independently of where client website data is physically hosted, IGS-Web LLC — as the data controller for data collected through this corporate website (contact forms, billing, account management) — is a US-registered entity. Remote access to, or administrative processing of, personal data by IGS-Web LLC's personnel (including Romain Jutel, as the operational contact point) constitutes an international data transfer under the GDPR whenever it occurs from outside the EEA/UK/Switzerland, regardless of where the underlying server is physically located.

Where such a transfer occurs from the EEA, the UK, or Switzerland to the United States or another country not recognized by the European Commission as providing an adequate level of data protection, IGS-Web LLC applies appropriate safeguards required by the GDPR, such as the European Commission's Standard Contractual Clauses (SCCs), the UK International Data Transfer Addendum where relevant, or another legally recognized transfer mechanism, together with supplementary technical and organizational measures where appropriate.

A list of sub-processors, their locations, and further detail on the hosting location applicable to a specific client engagement or the transfer mechanism applied to administrative processing can be requested at [email protected].

Visitor comments may be checked through automated spam detection services, which may involve processing outside the EU under the safeguards described above.

13. Changes to This Policy

This privacy policy may be updated at any time to comply with legal requirements or changes to the website, to the identity or location of the data controller, or to hosting arrangements, as reflected in this update following the transfer of website operation from its previous French sole-trader operator to IGS-Web LLC, with Romain Jutel continuing as the designated GDPR contact.
